Legislative Accomplishments 2009
During the 2009 Session, I was the Primary Sponsor of 16 Bills. Of 16, 2 became law.
The following two proposals became Law:

Fairness in CON Determinations/Inflation Adj. |
This is the 2nd law I have worked passed to streamline the State’s cumbersome CON process. This bill raises the level that can be spent renovating facilities before a Certificate of Need must be applied for. This means owners of nursing homes, adult care homes or homes for the mentally handicapped can invest more money in improving their facilities and hiring more qualified staff.

Fire and Rescue Pension Withdrawal Change. |
This Bill helps firemen and rescue workers participating in the Pension plan to protect their investment.

Defense of Marriage. |
Despite having a Majority of the House sign-up to support the Bill, House Leadership never allowed it to be heard. The text of the Bill is long but explains why I believe it so very important to support and strengthen North Carolina’s families.

Study Fire Ants. |
Fire Ants are a serious threat to the health of North Carolina’s citizens-especially kids. At some point, we are going to have to eradicate the dangerous and growing threat.

Tax Credit for Hiring Unemployment Recipient. |
This series of Bills recognize that businesses create jobs-not government. They provided common sense incentives to businesses for putting people back to work.

Eminent Domain. |
Recent Court decisions said that Government could take private property from one person and sell it to another if it created “public benefit” to do so. I think North Carolina’s Constitution should specify that this is not legal in our State. I was able to get this Amendment passed through the House but it was not heard in the Senate.

Modernization of the State's ABC System. |
I recognized that local ABC Boards needed additional accountability and performance standards to make sure they met their mission to control the flow of alcohol and put the profits earned from selling liquor back into their respective communities. The Bill was not heard but the issue has been brought to light by recent newspaper articles illustrating local abuses of the systems.

Clarify the New NC Drought Response. |
I saw some disturbing possibilities of the state being able to overstep its bounds without due process. I especially am disturbed that private water wells on private land can be controlled by the State. I hope to address this and other concerns regarding right-of-ways in the 2010 Session.

In-State Tuition for DOD Emps/Tuition Refund. |
I feel all Americans owe such a debt of gratitude to our military. This Bill would have let those people stationed in North Carolina while serving our Country, pay in-state tuition at our community colleges and universities.

Local Tax Lien/ Priority Over State Tax Lien. |
I’m still working on this issue too. Our laws are a bit unclear over who can seek to enforce a tax lien-the feds, the state, or the local authorities. This leads to property being foreclosed upon and then becoming abandoned and overgrown because no authority will clearly act to sell the property to someone who can make it a home or business again. I do not want anyone to lose their home or business because they did not pay their taxes. When it happens, however, I also don’t want to see the property sit abandoned and be a nuisance to the surrounding property owners.
